Terms of Service.

1 Acceptance of Terms

These Terms of Service are an agreement between you and Emto Max Holdings Ltd (Anguilla) for your use of EM : Beyond Reach. By activating a device, accessing the service, or continuing to use it, you agree to these Terms. If you do not agree, do not activate or use the service.

You must have the legal capacity to enter into this agreement. If you use EM for an organisation, you confirm that you are authorised to accept these Terms for that organisation.

2 Nature of the Service

EM is a sovereign, closed-loop private communications platform. It uses an isolated, hardened Matrix instance with federation disabled. It is not connected to the public Matrix network and does not provide access to public rooms or third-party homeservers.

The service is supplied with GrapheneOS-hardened Google Pixel 8+ hardware. EM infrastructure is hosted in Anguilla and is operated outside the 5/9/14-Eyes surveillance alliances. The service uses sovereign backup links and encrypted tunnels as part of its isolated infrastructure.

EM provides a controlled communications perimeter. It does not promise that any system can prevent every compromise, outage, legal order, or act by a third party.

3 Zero KYC No PII & Registration

EM uses no KYC process and does not require personal identifying information (PII) to register. Activation uses a three-word activation token. Your account also uses a 12-word seed phrase that you must protect.

There is no key escrow. EM cannot recover a lost seed phrase, restore access to a lost device, or decrypt your messages for you. Anyone with your activation details or seed phrase may be able to access the account, so keep them private.

4 Subscription Pricing & Renewal

The subscription price is £1,200 per year. Payment is Monero-only via NOWPayments. EM does not accept fiat currency for the subscription. There are no refunds and no chargebacks; payments are final.

You are responsible for paying before your current subscription ends if you want uninterrupted access. A payment that is delayed, incomplete, or not confirmed may cause the account to move through the lifecycle described below.

5 Account Lifecycle & Cryptographic Shredding

The account lifecycle is automatic:

• Days 1–365: the account has full access while the subscription is active.
• Days 336–365: this is the renewal window. You may renew during this period and keep the account active.
• Day 366: an unpaid account enters Restricted Mode.
• Day 373: the account is automatically and permanently cryptographically shredded. Account records, keys, and associated metadata cannot be recovered after this process.

For onboarding, device setup, and activation, use @setup:chat.emtome.io. For general support, use @support:chat.emtome.io. EM does not provide web portals or email support for these channels.

6 Zero Tracking & Data Isolation

EM does not log IP addresses and does not use third-party trackers, external APIs, US CDNs, or Google Analytics in the closed-loop platform. The service is designed to keep account and communications data inside its isolated perimeter.

This commitment does not make the public internet, a user’s device, or a recipient’s device risk-free. You remain responsible for securing your hardware, seed phrase, and any information you choose to share.

7 Acceptable Use

You must use EM lawfully and responsibly. You must not use it to distribute child sexual abuse material, make credible threats, harass or abuse others, distribute malware, gain unauthorised access to systems, or automate activity that disrupts the service or harms other users. Our Acceptable Use Policy forms part of these Terms.

8 Limitation of Liability & Disclaimer of Warranties

EM is provided on an “as is” and “as available” basis. To the fullest extent permitted by Anguilla law, we disclaim warranties that the service will be uninterrupted, error-free, or suitable for every purpose.

To the fullest extent permitted by law, Emto Max Holdings Ltd (Anguilla) will not be liable for indirect, incidental, special, consequential, or lost-profit losses. Our total liability for a claim relating to the service is limited to the subscription fees you paid to us for the 12 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

9 Governing Law & Jurisdiction

These Terms are governed by the laws of Anguilla. The courts of Anguilla have exclusive jurisdiction over any dispute arising from or relating to these Terms or the service.
